C&S Wholesale Grocers is suing Kroger over the retailer’s failed bid to acquire Albertsons, according to a report.
C&S Wholesale Grocers has sued Kroger in Delaware state court, citing the retailer’s failure to pay a promised $125 million termination fee, according to reporting from The Wall Street Journal.
In December, Albertsons also filed a lawsuit against Kroger, suing for a $600 million breakup fee following its failed merger deal and stating that Kroger refused to offer an adequate divestiture package and repeatedly ignored regulators’ concerns—moves that Albertsons claims caused the merger to be blocked.
